WHO MAY BE RESPONSIBLE FOLLOWING A TRUCK ACCIDENT IN TENNESSEE?

Countless large trucks barrel down Tennessee highways every day. Some drivers may be apprehensive around these huge vehicles, which seemingly dominate the road. If you have had the unfortunate experience of getting involved in an accident with a large truck, you should know whom to hold accountable.

The Federal Motor Carrier Safety Administration reports that in 2013, large trucks were involved in accidents that resulted in 4,329 traffic fatalities and 66,120 injuries. The agency conducted a study in conjunction with the National Highway Traffic Safety Administration to determine what causes these accidents. The majority of such incidents were driver-related, due to items such as driving recklessly, engaging in a distraction or drinking behind the wheel. Vehicle equipment issues also played a role in a significant number of incidents.

Depending on the circumstances, you may be able to file a claim against one or more of the following parties following your accident:

  • The driver: If the driver is at fault for the incident, such as carelessly driving, he or she could be criminally and financially responsible.
  • The trucking company: Truck companies have a duty to do thorough background checks on their drivers, regularly inspect vehicles and properly maintain them.
  • The truck manufacturer: If the truck has a defect, the company that built it could be liable for your damages.

Under Tennessee law, you have one year from the date of the incident to file a personal injury lawsuit. Make sure you compile as much information possible for your claim, including any expenses you have incurred, names and contact information for witnesses and a timeline of events.

While this information may be useful, it should not be taken as legal advice.
